These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “Client,” “you,” or “your”) and Media Midwest (“Media Midwest,” “we,” “us,” or “our”) governing your access to and use of our website, online store, products, services, photography, videography, custom design services, events, partnerships, sponsorship programs, and related offerings.
By accessing our website, placing an order, booking a service, submitting an inquiry, approving a design, participating in a Media Midwest program, or otherwise engaging with Media Midwest, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, you should not use our services or place an order.
1. GENERAL TERMS
Media Midwest provides automotive media, photography, videography, custom decals, graphics, merchandise, creative services, promotional services, and related offerings.
These Terms govern the relationship between Media Midwest and the individual or entity utilizing our products or services.
Additional terms may apply to particular products, services, events, partnerships, sponsorships, or agreements.
Where a specific written agreement conflicts with these Terms, the specific agreement may control the applicable transaction.
2. ELIGIBILITY
By using Media Midwest services, you represent that:

You have the legal capacity to enter into an agreement.

The information you provide is accurate.

You are authorized to use any payment method supplied.

You have authority to approve any materials submitted on behalf of another individual or business.

You will comply with applicable laws and regulations.
If you are acting on behalf of a business or organization, you represent that you possess sufficient authority to bind that entity to these Terms.
3. ORDERS & PURCHASES
All orders are subject to acceptance by Media Midwest.
We reserve the right to:

Decline an order

Limit quantities

Correct pricing errors

Correct product descriptions

Request additional information
-
Refuse service
-
Suspend an order pending clarification
An order is not considered fully accepted until Media Midwest has received the applicable payment and confirmed the order.
4. CUSTOM PRODUCTS
Many Media Midwest products are customized specifically for individual customers.
Custom products may include:

License plates

Custom lettering
-
Custom names
-
Vehicle graphics

Apparel
-
Promotional materials
-
Other personalized products
Customers are responsible for ensuring that all submitted information is accurate.
Once a custom design has been approved, production may begin.
5. DESIGN APPROVAL
Customers are responsible for thoroughly reviewing all proofs, mockups, and design previews before approval.
Approval constitutes authorization for Media Midwest to proceed with production.
Customers should verify:

Other design specifications
Once approved, changes may be subject to additional charges.
6. REVISIONS & REMAKES
Customer-requested revisions or remakes following design approval may incur an additional charge.
Unless otherwise specified in writing, the standard charge is:
75% OF THE ORIGINAL PRODUCT PRICE
The applicable revision or remake fee must be paid in full before additional work begins.
If a physical product must be shipped, applicable shipping charges are additional.
This provision exists because customized production may require materials, labor, equipment, design time, and other resources that cannot reasonably be recovered after production has commenced.
7. PRICING
Prices displayed by Media Midwest are subject to change without notice.
Unless expressly stated otherwise, prices do not necessarily include:

Taxes
-
Installation
-
Travel
-
Additional design work
-
Additional editing
-
Additional revisions
-
Other separately chargeable services
Media Midwest reserves the right to correct inadvertent pricing or listing errors.
8. PAYMENT
Payment must be received according to the applicable order or service requirements.
Depending on the transaction, Media Midwest may require:

Full payment upfront

A deposit

A booking fee
-
A retainer
-
Milestone payments
-
Payment before production
-
Payment before delivery
Failure to provide required payment may result in cancellation, suspension, or postponement of the applicable order or service.
9. PHOTOGRAPHY SERVICES
Photography services constitute scheduled creative services.
Services may include:

Automotive photography
-
Portrait photography
-
Event photography
-
Product photography
-
Promotional photography
-
Rolling photography
-
Commercial photography
-
Other photographic services
Booking a photography session reserves Media Midwest's time and resources specifically for the customer.
Accordingly, cancellations, no-shows, rescheduling, and refunds may be subject to additional restrictions.
10. VIDEOGRAPHY SERVICES
Videography services constitute scheduled creative services and may include:

Automotive videography

Cinematography
-
Rolling videos
-
Promotional videos
-
Social media content
-
Event coverage
-
Vehicle feature videos
-
Commercial video
-
Other video services
Video production may involve filming, equipment preparation, editing, rendering, file delivery, and other labor-intensive processes.
Once work has commenced, cancellation may not entitle the customer to a full refund.
11. CREATIVE DISCRETION
Photography, videography, graphic design, editing, and other creative services inherently involve artistic judgment.
Unless otherwise agreed in writing, Media Midwest retains reasonable creative discretion regarding:

Composition

Lighting
-
Framing
-
Color grading
-
Editing
-
Typography
-
Graphic arrangement
-
Cinematic style
-
Music selection
-
Visual presentation
A customer's subjective disagreement with a creative style does not necessarily constitute a service defect.
12. EDITING & ADDITIONAL WORK
Additional editing, redesign, re-editing, or post-production requested after approval may require additional compensation.
Examples include:

Rebuilding an approved design
-
Re-editing completed photographs
-
Re-editing completed videos
-
Adding new footage
-
Changing an approved concept
-
Creating additional versions
-
Requesting additional deliverables
Media Midwest may provide a separate quotation for substantial additional work.
13. APPOINTMENTS & SCHEDULING
Customers are responsible for arriving on time for scheduled services.
Late arrival may reduce the available service period.
Media Midwest is not obligated to extend a session because of customer-caused delays when doing so would interfere with other scheduled commitments.
Repeated scheduling changes may result in additional fees.
14. CANCELLATIONS & NO-SHOWS
Failure to attend a scheduled session without appropriate notice may constitute a no-show.
No-shows may result in forfeiture of applicable deposits, booking fees, retainers, or payments.
Customers should communicate cancellations or scheduling conflicts as early as reasonably possible.
15. WEATHER & UNFORESEEN CONDITIONS
Media Midwest may reschedule outdoor photography or videography due to:

Severe weather
-
Unsafe road conditions
-
Extreme temperatures
-
Poor visibility
-
Environmental hazards
-
Location restrictions
-
Other circumstances that materially interfere with safe service delivery
Weather-related rescheduling does not automatically create a right to a refund.
16. TRAVEL
Certain services may require travel.
Travel expenses may include:

Mileage
-
Parking
-
Tolls
-
Lodging
-
Transportation
-
Other reasonable travel expenses
Applicable travel charges will be communicated when relevant.
Once non-refundable travel expenses have been incurred, those expenses may not be refundable.
17. CUSTOMER RESPONSIBILITIES
Customers are responsible for:

Providing accurate information

Providing necessary approvals
-
Arriving on time
-
Providing safe access to agreed locations
-
Maintaining appropriate conduct

Providing legally usable materials
-
Following installation instructions
-
Protecting delivered digital files

Maintaining accurate contact information
Failure to satisfy customer responsibilities may affect Media Midwest's ability to complete the requested service.
18. VEHICLE & LOCATION SAFETY
Media Midwest reserves the right to suspend or terminate a session when conditions present an unreasonable safety risk.
This may include:

Reckless driving

Illegal activity
-
Unsafe vehicle operation
-
Dangerous locations
-
Severe weather
-
Threatening behavior
-
Harassment
-
Equipment hazards
Media Midwest is not obligated to perform a service under unsafe conditions.
19. INTELLECTUAL PROPERTY
Unless expressly transferred in writing, Media Midwest retains ownership of its original creative materials, including applicable:

Designs

Graphics
-
Templates
-
Branding
-
Photographic works
-
Video edits
-
Creative concepts
-
Promotional materials
-
Logos created by Media Midwest
-
Other original intellectual property
Purchasing a product or service does not automatically constitute a transfer of intellectual-property ownership.
20. CUSTOMER-PROVIDED MATERIALS
Customers may submit photographs, artwork, logos, text, graphics, trademarks, or other materials.
By submitting such material, the customer represents that they have sufficient rights or authorization to provide it for the requested purpose.
The customer remains responsible for claims arising from unauthorized use of third-party materials supplied by the customer.
21. PORTFOLIO & PROMOTIONAL USE
Subject to applicable permissions, releases, agreements, and law, Media Midwest may use eligible photographs, videos, designs, vehicles, products, or completed work for portfolio, advertising, marketing, social media, website, promotional, or other legitimate business purposes.
Where a separate written agreement governs promotional use, that agreement will control.
22. PARTNERS & SPONSORS
Media Midwest may collaborate with independent partners and sponsors.
Partners and sponsors are separate entities unless expressly stated otherwise.
Purchases, services, discounts, warranties, returns, and refunds provided directly by a partner or sponsor are generally governed by that entity's own terms.
Media Midwest does not guarantee the availability, quality, performance, pricing, or policies of an independent partner or sponsor.
23. PARTNER & SPONSOR REFUNDS
Refunds for products or services purchased directly from an independent Media Midwest partner or sponsor must generally be addressed with the applicable business.
Media Midwest will not issue refunds for transactions that Media Midwest did not process or receive payment for.
Customers are responsible for reviewing the applicable partner or sponsor's policies before completing a transaction.
24. WEBSITE USE
You agree not to use the Media Midwest website to:

Violate applicable law

Commit fraud
-
Attempt unauthorized access

Distribute malicious software
-
Interfere with website operations
-
Scrape or reproduce protected content without authorization

Impersonate another individual or organization
-
Submit intentionally misleading information

Abuse website functionality
Media Midwest may restrict or terminate access when necessary to protect the website, business, customers, or other users.
25. THIRD-PARTY SERVICES
Media Midwest may utilize third-party platforms for:

Scheduling

Advertising

Online commerce

Cloud storage
Third-party services may be governed by their own terms and privacy policies.
Media Midwest is not responsible for independent third-party outages, errors, policies, or practices beyond our reasonable control.
26. DISCLAIMERS
To the extent permitted by applicable law, Media Midwest provides its website, products, and services subject to the terms and limitations stated herein.
We do not guarantee that:

Every product will always remain available

Every service will always be available

Third-party services will remain operational
-
Delivery times will never change

Website information will never contain errors
Media Midwest will make reasonable efforts to provide accurate information and reliable services.
27. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Media Midwest shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website, products, services, or third-party services.
Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded or limited under applicable law.
28. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Media Midwest and its owners, employees, contractors, representatives, and affiliates from claims, liabilities, damages, losses, or expenses arising from:

29. TERMINATION & REFUSAL OF SERVICE
Media Midwest reserves the right to refuse, suspend, or terminate services when reasonably necessary, including circumstances involving:

Nonpayment

Fraud

Abuse

Harassment

Threatening conduct

Unsafe conduct

Repeated policy violations

Illegal activity
-
Misrepresentation

Unauthorized use of Media Midwest intellectual property
Termination does not automatically eliminate payment obligations that accrued before termination.
30. GOVERNING TERMS & ACCEPTANCE
These Terms, together with applicable order details, service agreements, policies, and other written agreements, constitute the terms governing your relationship with Media Midwest.
By placing an order, approving a design, booking a photography or videography session, purchasing a service, accessing the website, or otherwise engaging Media Midwest, you acknowledge that you have reviewed and agreed to these Terms.
Media Midwest reserves the right to modify these Terms when necessary. Updated Terms will include a revised effective date.
